OVERVIEW

This website is operated by GlowHavenLighting. Throughout these Terms of Service, “we,” “us” and “our” refer to GlowHavenLighting.

GlowHavenLighting provides this website, including its information, features, products and services, to offer customers a curated lighting-shopping experience. Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and services.

These Terms of Service, together with the policies referenced below, explain your rights and responsibilities when using our website or purchasing from us.

By accessing our website, creating an account or placing an order, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our website or services.

SECTION 1 — ELIGIBILITY AND ACCOUNTS

You must be at least the age of majority in your province, state or country of residence to make a purchase through our website.

You agree to provide accurate, current and complete information when creating an account or placing an order. You are responsible for protecting your account credentials and for activity conducted through your account.

You may not use our products or services for an unlawful or unauthorized purpose.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to present product descriptions, specifications, dimensions, photographs and colours accurately. However, colours and appearance may vary depending on lighting conditions, screen settings and the device being used.

Minor differences may exist between product images and the item received, including differences in colour tone, packaging or manufacturing details that do not materially affect the product’s intended function.

Product measurements may be approximate. Customers should review the listed dimensions, voltage, plug configuration, installation requirements and other specifications before ordering.

Product availability, specifications and pricing may change without notice. We may discontinue a product or limit the quantity available at any time.

Nothing in this section limits any mandatory consumer rights that apply to your purchase.

SECTION 3 — ELECTRICAL PRODUCTS AND INSTALLATION

Customers are responsible for selecting products with voltage, plug type, dimensions and installation requirements appropriate for their intended location.

Electrical products must be installed and used according to the supplied instructions and all applicable electrical and building regulations. Products requiring permanent wiring or electrical modification should be installed by a qualified electrician where required.

Outdoor or water-resistant products must only be used within their stated protection rating. A water-resistant product is not necessarily suitable for underwater or permanently submerged installation.

GlowHavenLighting is not responsible for damage caused by improper installation, unauthorized modification, use with an incompatible electrical system or use outside the product’s stated specifications. This does not exclude responsibility that cannot legally be excluded.

SECTION 4 — ORDERS

Submitting an order constitutes an offer to purchase. An automated confirmation acknowledges that we received the order but does not necessarily mean the order has been accepted.

An order is accepted once payment has been successfully processed and we confirm that the order will be fulfilled.

We may decline or cancel an order when reasonably necessary, including in cases involving suspected fraud, incorrect pricing, unavailable inventory, payment problems, shipping restrictions or an obvious product-information error.

If we cancel an order after payment has been collected, we will issue a refund to the original payment method.

Please review your order carefully before submitting it. Contact us promptly if you need to request a change or cancellation. We will try to accommodate the request, but changes cannot be guaranteed after processing or shipment has begun.

SECTION 5 — PRICES, TAXES AND PAYMENT

Prices are displayed in the currency selected or shown on the website. Prices, discounts and promotions may change without notice, but changes will not affect orders already accepted.

Applicable shipping charges and taxes will be displayed during checkout when available.

International orders may be subject to customs duties, import taxes, brokerage charges or other government fees. Unless expressly stated at checkout, these charges are not included in the product price and are the customer’s responsibility.

You agree to provide accurate billing and payment information and confirm that you are authorized to use the selected payment method.

SECTION 6 — SHIPPING AND DELIVERY

Shipping and delivery are governed by our Shipping Policy.

Processing and delivery estimates are provided for guidance and are not guaranteed. Delays may occur because of carriers, customs processing, severe weather, high order volumes or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Contact us promptly if an address needs to be corrected. We cannot guarantee corrections after an order has entered processing or shipment.

If tracking indicates that a package was delivered but you cannot locate it, please check the delivery location, household members and neighbours before contacting us. We will provide reasonable assistance with available carrier information.

Nothing in this section limits any rights or remedies available under applicable consumer law.

SECTION 7 — RETURNS, REFUNDS AND EXCHANGES

Returns, refunds, exchanges, damaged products and eligible cancellations are governed by our Return and Refund Policy:

Please contact us before returning an item. Unauthorized returns or items sent to an address not provided in our return instructions may not be accepted.

SECTION 8 — PROMOTIONS AND DISCOUNTS

Promotional offers may be subject to additional conditions, including eligibility requirements, expiration dates, product exclusions and limits on use.

Unless otherwise stated, discount codes cannot be combined. Promotions have no cash value and cannot be applied retroactively to completed purchases.

If promotional terms conflict with these Terms of Service, the specific promotional terms will govern that promotion.

SECTION 9 — THIRD-PARTY SERVICES AND LINKS

Our store is hosted by Shopify. Shopify provides the ecommerce technology that enables us to operate the online store, but purchases made through our store are transactions directly between you and GlowHavenLighting.

Shopify may process personal information as described in our Privacy Policy and Shopify’s applicable privacy documentation.

SECTION 11 — INTELLECTUAL PROPERTY

The GlowHavenLighting name, logo, website design and original website content are owned by or licensed to GlowHavenLighting and are protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, republish, sell or commercially exploit our protected content without prior written permission.

Third-party product names, images, trademarks and other materials remain the property of their respective owners.

If you submit a product review, photograph, suggestion or other feedback, you confirm that you have the right to provide it and that it is accurate and lawful.

You grant GlowHavenLighting a non-exclusive, worldwide, royalty-free right to use, reproduce and display submitted feedback for operating and promoting the store.

This provision does not apply to claims caused by GlowHavenLighting’s own unlawful conduct, negligence or breach of its obligations.

If any part of these Terms is found to be unlawful, invalid or unenforceable, that portion will be enforced to the greatest extent permitted by law or removed where necessary. The remaining provisions will continue in effect.

If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada, without preventing customers from relying on mandatory consumer protections available in their place of residence.
